(a) in the case of an insurer undertaking life insurance (other than a mutual benefit society) and that was not licensed on March 17, 1943, a certified copy of an order made under section 53 of the Insurance Companies Act (Canada);

Where a licensed insurer has obtained an order under section 53 of the Insurance Companies Act (Canada), the Minister of Finance may return to the insurer its deposit.

Section 50 is repealed and the following is substituted:

Payment out of deposit on reinsurance by insurer with federal order

Where a licensed insurer, hereinafter called the "continuing insurer", has acquired the assets and assumed the liabilities within the province of another licensed insurer, hereinafter called the "discontinuing insurer", or has reinsured all the contracts of a discontinuing insurer outstanding within the province, and where the continuing insurer has obtained an order under section 53 of the Insurance Companies Act (Canada), the Minister of Finance may, upon the application of the continuing insurer and the discontinuing insurer, pay out the deposit of the discontinuing insurer to the continuing insurer or to the discontinuing insurer.

12(5)

Subsection 76(1) is repealed and the following is substituted:

Investment of surplus funds

76(1)

An insurer, incorporated and licensed under the laws of the province, may invest its surplus funds and reserve in any investments in which an insurer who has obtained an order under section 53 of the Insurance Companies Act (Canada) is permitted under that Act to invest its funds.

Subsection 88(8) is repealed and the following is substituted:

Insurer with federal order

Where an insurer has obtained an order under section 53 of the Insurance Companies Act (Canada), the requirements of this section with reference to that insurer in respect of valuations, deductions and rates of interest may be modified or altered as may be necessary to permit the insurer to comply with the requirements of the Superintendent of Financial Institutions appointed pursuant to the Office of the Superintendent of Financial Institutions Act (Canada).

Subsection 396.1(2) of the English version is amended by striking out "establishement" and substituting "establishment".

THE LEGAL AID SERVICES SOCIETY OF MANITOBA ACT

The Legal Aid Services Society of Manitoba Act is amended by this section.

Subsection 17.1(2) is repealed and the following is substituted:

Registration of statement in L.T.O.

Where an applicant who owns or has an interest in land in Manitoba receives legal aid, the executive director may register in a Land Titles Office a statement certifying that the applicant has received legal aid and setting out the name of the applicant, the legal description of the land, and the society's address for service.

13(3)

Subsection 17.1(4) is repealed and the following is substituted:

Effect of registration

17.1(4)

From the time of its registration, a statement registered under subsection (2) binds and forms a lien and charge on the applicant's estate or interest in the land against which it is registered for an amount equal to the cost of the legal aid provided to the applicant, before and after the date of registration; but no such statement has the effect of severing a joint tenancy or affecting a right under The Dower Act.

The definition "regulation" in section 1 is repealed and the following is substituted:

"regulation" means

(a) a regulation, rule, order or by-law that

(i) is of a legislative nature and is made or approved in the execution of a power conferred by or under an Act of the Legislature, or

(ii) governs practice or procedure in quasi-judicial proceedings and is made or approved in the execution of a power conferred by a provision of an Act of the Legislature that uses the word "regulation" in conferring the power,

by

(iii) the Lieutenant Governor in Council, a group of ministers or a minister,

(iv) an individual, or

(v) a board, commission, association or other body, whether incorporated or unincorporated, all the members of which or all the members of the board of management or board of directors of which are appointed by an Act of the Legislature or by the Lieutenant Governor in Council, or

(b) a rule or regulation that governs practice or procedure in judicial proceedings and is made or approved in the execution of a power conferred by or under an Act of the Legislature,

but does not include

(c) a regulation, rule, order, by-law or resolution when made by a local authority,

(d) provisions that form part of a regulation, rule, order or by-law and that are adopted or incorporated by reference in the regulation, rule, order or by-law,

(e) a regulation, rule, order or by-law of The Municipal Board or The Public Utilities Board,

(f) a proclamation bringing into force or suspending an Act or a portion of an Act of the Legislature, or

(g) an order that is made in the execution of a power conferred by or under an Act of the Legislature and which confirms or disallows a regulation, rule, order or by-law. («règlement»)

Public Schools Act re validation of 1986 mill rate differential in support levy

Notwithstanding subsection 181(2) of The Public Schools Act, the number of mills differential allowed between education farm and residential assessment and other assessment for 1986, as set out in Order in Council 300/86, is 38 mills, and all decisions, actions and proceedings taken, all monies, levies or taxes paid or received, all penalties assessed or collected, and all rights or duties exercised with respect to that Order in Council, are hereby declared to be valid and binding on all persons affected by them.

Notwithstanding subsection 181(2) of The Public Schools Act, the number of mills differential allowed between education farm and residential assessment and other assessment for 1987, as set out in Order in Council 163/87, is 43.7 mills, and all decisions, actions and proceedings taken, all monies, levies or taxes paid or received, all penalties assessed or collected, and all rights or duties exercised with respect to that Order in Council, are hereby declared to be valid and binding on all persons affected by them.

COMING INTO FORCE

Coming into force

Subject to subsections (2) to (17), this Act comes into force on the day it receives royal assent.

Coming into force:  sections 1, 2, 6, 11(3) to (6), 20(2), 27(2),(5) and (6), 34 and 39
