The Personal Property Security Amendment Act

(Assented to June 24, 1992)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Personal Property Security Act is amended by this Act.

2(1)

Subsection 48(5) is amended by striking out "security".

2(2)

The following is added after subsection 48(5):

Effect of error in name of debtor

48(6)

An error in the spelling of any part of the name of a debtor set forth in a financing statement or other document required or authorized to be registered in the personal property registry invalidates the registration and destroys the effect of the registration unless, in the opinion of a judge or court, the error has not actually misled a person whose interests are affected by the registration.

Coming into force

This Act is retroactive and is deemed to have come into force on September 1, 1978.
