The Sperling Joint Community Centre District Act

WHEREAS in or about 1921 the Rural Municipality of Morris, the Rural Municipality of Macdonald and the Rural Municipality of Dufferin contributed jointly to the construction of a curling and skating rink in the community known as Sperling, in the Rural Municipality of Morris;

AND WHEREAS by an Act to create "The Community District of Sperling" for Certain Purposes, chapter 99 of the Statutes of Manitoba, 1926, a community district known as "Sperling Community District" was created, establishing a board of trustees for the purpose of holding in trust the skating and curling rink and the premises connected to them, and for the management of the affairs of the rink and the associated premises;

AND WHEREAS the members of the Board of Trustees created by An Act to create "The Community District of Sperling" for Certain Purposes, aforesaid, are the registered owners of land under Certificates of Title Nos. A 26339 and A 26340;

AND WHEREAS pursuant to Section 439 of The Municipal Act, the municipalities have by by-law provided for the establishment of a joint community centre district, known as "The Sperling Joint Community Centre District" and have entered into an agreement to establish a joint community centre district board known as "The Sperling Joint Community Centre District Board" to supervise and co-ordinate the maintenance and operation of a community centre for the use of the residents of the municipalities;

AND WHEREAS the municipalities have agreed that the land at Sperling, on which the curling and skating rink is situated, and the buildings and premises on it, be vested in the Rural Municipality of Morris for the purposes of the Sperling Joint Community Centre District and under the supervision and control of the Sperling Joint Community Centre District Board;

AND WHEREAS the Minister of Justice has caused this Act to be prepared in English and French for re-enactment in accordance with a judgment dated June 13, 1985 and an order dated November 4, 1985 of the Supreme Court of Canada;

THEREFORE HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Lands vested in R.M. of Morris

The following lands are hereby vested in the Rural Municipality of Morris:

Parcel 1:  In the Village of Sperling, in Manitoba, and being Lot 1, in Block A, shown on a Plan of Survey of the Village, registered in the Morden Land Titles Office as No. 842-C;

Parcel 2:  In the Village of Sperling, in Manitoba, and being Lot 8, in Block A, shown on a Plan of Survey of the Village, registered in the Morden Land Titles Office as No. 842-C.

Lands held for community centre

The Rural Municipality of Morris shall hold the lands for the use of a community centre for the public use of the residents of The Rural Municipality of Morris, The Rural Municipality of Macdonald and The Rural Municipality of Dufferin, to be maintained and operated by the Sperling Joint Community Centre District Board.
