The Oakwood War Memorial Scholarship Board Act
(Assented to March 15, 1990)
WHEREAS certain trustees for the people of the town of Oak Lake and the rural municipalities of Sifton and Woodworth have a sum of money collected for the purpose of establishing a memorial to the soldiers of the district who served in the Great War;
AND WHEREAS it has been decided by the trustees that the memorial should take the form of a scholarship or scholarships payable annually or otherwise, as the income from the fund permits, to some merited student or students in Grade 9 in the Oak Lake Junior High School in The Fort La Bosse School Division No. 41;
AND WHEREAS it is considered expedient to provide for the proper management of the scholarship;
AND WHEREAS the Minister of Justice has caused this Act to be prepared in English and French for re-enactment in accordance with a judgment dated June 13, 1985 and an order dated November 4, 1985 of the Supreme Court of Canada;
THEREFORE HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
This Act may be cited as "The Oakwood War Memorial Scholarship Act" and shall be deemed to be a public Act.
There is hereby created a corporation that shall be a board of trustees under the name of "The Oakwood War Memorial Scholarship Board".
The board of trustees shall be a body corporate and shall be composed of the persons from time to time holding the following offices: the mayor of the town of Oak lake, who shall be the chairperson of the board, the reeves of the rural municipalities of Sifton and Woodworth, the trustee for Ward 5 of The Fort La Bosse School Division No. 41, and the Secretary Treasurer of the town of Oak Lake.
All monies contributed by the people of the community or received from other sources for the purpose of a War Memorial Scholarship shall, with the proceeds of the investment of the monies, the securities so invested, interest and donations received in future, be a fund of which the board shall be trustees.
Subject to The Trustee Act, the board shall invest the fund, and may retain possession or control of securities, and from time to time convert and re-invest any securities.
The board may receive donations of property of every kind and description, wherever situated, whether by transfer, deed, will, gift or otherwise, with full power to use and administer the property or the proceeds of their sale for the purposes of the fund, subject to any limitation imposed by the donor.
The annual net income from the fund shall be devoted to the payment of a scholarship or scholarships in an amount or amounts as are from time to time decided by regulation of the board, by annual or semi-annual instalments, to a pupil or pupils of Grade 9 in the Oak Lake Junior High School in the Fort La Bosse School Division No. 41 in regular attendance and of satisfactory progress according to a standard requirement or method of certification to be set out in the regulations.
The board shall prepare, and may from time to time amend, regulations governing the qualifications of candidates for the scholarship, the terms and conditions under which, and the times when, it is to be awarded, and a copy of the regulations, certified by the secretary of the board, shall be available for inspection at the school by any ratepayer of the town or of the municipalities, or by any pupil in the school.
The members of the board shall receive no remuneration for their services, but may pay an amount not exceeding the sum of $10. annually for their expenses in the administration of the fund, and the expenses shall be paid from the fund.
The accounts of the board shall be audited at least once each year by a person who is not a member of the board, appointed by the board for the purpose.
Any complaint against the administration of the fund shall be made to the chairperson of the board, who shall have power to investigate the complaint and to deal with it as she or he sees fit, and the chairperson's determination of the matter is final and conclusive.
