The Forest Amendment Act

(Assented to March 15, 1990)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Forest Act is amended by this Act.

Clause 2(d), French version, repealed and substituted

The French version of clause 2d) is repealed and the following is substituted:

d) le reboisement d'extension, le reboisement de reconstitution, la protection des arbres et l'amélioration des arbres;

Subsection 8(1), French version, amended

The French version of subsection 8(1) is amended by adding "de reconstitution" after "le reboisement."

Subsections 34(1.1) and (1.2) added

The following is added after subsection 34(1):

Payment of forest renewal charge

34(1.1)

A holder of a timber cutting right shall

(a) pay to the Crown a forest renewal charge as prescribed in the regulations; or

(b) if the minister approves, carry out forest renewal on forest land that has been harvested by the holder.

Forest renewal

34(1.2)

The holder of a timber cutting right who carries out forest renewal under clause (1.1)(b) shall do so according to such terms and conditions as are set out in the licence, permit or other authorization under which timber is cut or as may be prescribed in the regulations.

Section 41 amended

Section 41 is amended by renumbering it as subsection 41(1) and by adding the following after clause (a):

(a.1) establishing the amount of the forest renewal charge for the purpose of subsection 34(1.1);

(a.2) prescribing the terms and conditions under which forest renewal shall be carried out under subsection 34(1.2);

Subsection 41(2) added

The following is added as subsection 41(2):

Application of regulations

41(2)

A regulation made under clause 41(1)(a.1) may apply to timber cutting rights granted before or after the regulation comes into force and may apply to all or to particular kinds of timber cutting rights.

Coming into force

This Act comes into force on the day it receives royal assent.
