This regulation is made under the Canadian Broiler Hatching Egg Marketing Agency Delegation Regulation, Manitoba Regulation 230/87 R, and is Regulation No. 1, 2003 of the Canadian Broiler Hatching Egg Marketing Agency.

Definitions

1(1)   In this regulation,

"Agency" means the Canadian Broiler Hatching Egg Marketing Agency;

"producer" means a person engaged in the production of broiler hatching eggs in Manitoba.

1(2)   All other expressions that are defined in the Manitoba Broiler Hatching Egg Marketing Plan Regulation have the same meaning as in that regulation.

Levy on Eggs Marketed

2(1)   A levy is imposed on each broiler hatching egg producer of $0.0022 per broiler hatching egg marketed by the producer in Manitoba.

2(2)   A levy imposed under subsection (1) is due and payable by the producer to the Agency at the time and place of the marketing of the broiler hatching eggs by the producer.

2(3)   A person who receives broiler hatching eggs from a producer shall deduct from the monies payable for the eggs all levies payable by the producer to the Agency and shall pay the amount of the levies to the Manitoba Broiler Hatching Egg Commission at the commission office,

(a) if the person is a hatchery operator, not later than 14 days after the last day of the week in which the broiler hatching eggs are hatched; and

(b) otherwise, not later than seven days after the last day of the week in which the person received the eggs from the producer.

Levy on Eggs Hatched

3(1)   A levy is imposed on each broiler hatching egg producer of $0.0022 per broiler hatching egg used by the producer for hatching purposes.

3(2)   A broiler hatching egg producer shall pay all levies imposed on the producer under subsection (1) to the Manitoba Broiler Hatching Egg Commission at the commission office not later than 14 days after the last day of the month in which the broiler hatching eggs are placed in an incubator.

Appointment of Commission as agent

4   The agency hereby appoints the Manitoba Broiler Hatching Egg Commission its agent for the purpose of collecting the levies imposed by this regulation.

Repeal

5   The Canadian Broiler Hatching Egg Marketing Agency Levy Regulation, Manitoba Regulation 21/2001, is repealed.

Coming into force

6   This regulation comes into force and is applicable to all eggs set on and after January 1, 2003.
