Definitions
1 In this regulation,
"Act" means The Education Administration Act; (« Loi »)
"agreement" means the licensing agreement entered into by the minister and the Canadian Copyright Licensing Agency under subsection 3.1(2) of the Act; (« contrat »)
"designated educational institution" means an educational institution designated under section 2. (« établissement d'enseignement désigné »)

« contrat » Contrat de licence que le ministre a conclu avec le Canadian Copyright Licensing Agency en vertu du paragraphe 3.1(2) de la Loi. ("agreement")

Designated educational institutions
2 The following educational institutions are designated as educational institutions authorized to copy works pursuant to the agreement:
(a) all school divisions;
(b) all school districts;
(c) all special revenue school districts;
(d) all private schools and institutional schools that receive support or grants under The Public Schools Act.
Établissements d'enseignement désignés
2 Les établissements d'enseignement indiqués ci-après sont autorisés à copier des ouvrages conformément au contrat :
a) les divisions scolaires;
b) les districts scolaires;
c) les districts scolaires ayant un financement particulier;
d) les écoles privées et les écoles en établissement qui reçoivent des subventions ou de l'aide en vertu de la Loi sur les écoles publiques.
Terms and conditions
3 In copying works pursuant to the agreement, each designated educational institution shall comply with
(a) all applicable terms and conditions set out in the agreement; and
(b) the provisions of every notice received from the government under the agreement.

3 Les établissements d'enseignement désignés qui copient des ouvrages conformément à un contrat respectent :

Fees payable for copying authorization
4(1) Subject to section 5, for authorization to copy works pursuant to the agreement, each designated educational institution shall pay to the minister the fees set out in the agreement.

4(1) Sous réserve de l'article 5, les établissements d'enseignement désignés versent au ministre les droits fixés dans le contrat pour obtenir l'autorisation de copier des ouvrages en vertu du contrat.
4(2) The fees payable under subsection (1) cover a designated educational institution's share of
(a) any fee payable by the government to the Canadian Copyright Licensing Agency under the agreement; and
(b) any administrative costs incurred by the government in carrying out the agreement.
4(2) Les droits que les établissements d'enseignement désignés versent en application du paragraphe (1) couvrent leur part :
a) des droits que le gouvernement verse au Canadian Copyright Licensing Agency en vertu du contrat;

Fees deductible from grants
5 The fees payable by a designated educational institution under section 4 shall be deducted by the minister from the support or grant payable to the designated educational institution under The Public Schools Act, and that portion of the fees referred to in clause 4(2)(a) shall be applied toward any fee payable by the government to the Canadian Copyright Licensing Agency under the agreement.
Droits et subventions
5 Le ministre défalque les droits que doivent verser les établissements d'enseignement désignés en application de l'article 4 des subventions ou de l'aide auxquelles ceux-ci ont droit en vertu de la Loi sur les écoles publiques. La partie des droits visée à l'alinéa 4(2)a) couvre les droits que le gouvernement doit verser au Canadian Copyright Licensing Agency en vertu du contrat.
