This Order is made under the Manitoba Processing Potato Marketing Plan Regulation, Manitoba Regulation 206/2006, and is Order No. 4, 2007 of Keystone Potato Producers Association.

Form established

1   A potato growing agreement used by a processor in acquiring potatoes from a producer must deal with the subject matters set out in the Schedule to this Order in a manner satisfactory to the board.

Submission of form for approval

2   A processor may submit a proposed form of potato growing agreement to the board for a determination as to whether or not such proposed form of potato growing agreement complies with the Schedule.

SCHEDULE

A potato growing agreement used by a processor in acquiring potatoes from a producer must:

1.Identify the agreement as a potato growing agreement made pursuant to the Manitoba Processing Potato Marketing Plan Regulation, Manitoba Regulation 206/2006.

2.Identify the name and business address of the registered processor.

3.Identify the name and business address of the registered producer.

4.Provide for the binding sale by the producer as vendor and the binding purchase by the processor as purchaser of potatoes.

5.Identify the crop year in which the potatoes will be produced.

6.Identify the variety of potatoes being sold and purchased.

7.Identify the volume by weight of potatoes being sold and purchased.

8.Identify the land on which potatoes will be grown.

9.Identify the property on which potatoes will be stored between harvest and delivery to the processor.

10.Identify the acceptable/unacceptable standards applicable to the potatoes being sold and purchased and provide the means for determining whether or not the potatoes meet such standards to be applied on delivery to processor.

11.Be signed by the producer or an authorized representative of the producer and clearly indicate the date of such signature.

12.Be signed by the processor or an authorized representative of the processor and clearly indicate the date of such signature.
