This order is made under the Manitoba Chicken Producers Marketing Plan Regulation, Manitoba Regulation 246/2004, and is Order No. 3(HE) 2007 of the Manitoba Chicken Producers.
NOTE: This order replaces Manitoba Regulation 170/99, which was repealed by Manitoba Regulation 49/2008.

Registration of broiler hatching egg producers

1   No person shall raise or keep broiler breeder laying hens or shall engage in the marketing of broiler hatching eggs in Manitoba unless that person is currently registered with this Board as a broiler hatching egg producer.

Quota requirement

2   No person shall be entitled to be registered as a broiler hatching egg producer unless such person has been allotted, or is entitled to be allotted, a broiler breeder laying hen quota and an intraprovincial quota by this Board.

Manner of application for registration

3   Every application for registration shall be in writing in the form prescribed by this Board, signed by the applicant, and shall be forwarded to the head office of this Board together with the requisite fee, if any, prescribed from time to time by resolution of this Board.

Licensing of hatchery operators

4   No person shall operate a hatchery or engage in the hatching of broiler hatching eggs in Manitoba unless that person is currently licensed by this Board as a hatchery operator.

Qualification requirement

5   No person shall be entitled to be licensed as a hatchery operator by the Board unless that person is licensed to conduct a commercial hatchery under The Livestock and Livestock Products Marketing Act (Manitoba) and holds a Certificate of Hatchery Accreditation from the Canadian Food Inspection Agency.

Manner of application for license

6   Every application for a license shall be in writing, in the form prescribed by this Board, signed by the applicant, and shall be forwarded to the head office of this Board together with the requisite fee, if any, prescribed from time to time by resolution of this Board.

Condition of registration or license

7   This Board may register a person as a broiler hatching egg producer or may issue a license to a hatchery operator, or may renew, suspend, cancel, or reinstate a person's registration or a license, or may register a person or issue a license for a prescribed period of time.
