Corrections and minor changes made under the authority of section 25 of The Statutes and Regulations Act

General information about corrections and minor changes
The Statutes and Regulations Act requires Manitoba legislation to be published on the Manitoba Laws website. Under subsection 25(1) of the Act, the chief legislative counsel is required to correct consolidation and publication errors. Under subsection 25(2) of the Act, the chief legislative counsel may make minor corrections or changes to the consolidated version of an Act or regulation without changing its legal effect.
Notice of the following types of minor changes must be given:
- replacing a description of a date or time with the actual date or time; [s. 25(2)(f)]
- replacing a reference to a bill or any part of a bill with a reference to the resulting Act or part of the Act after the bill is enacted and assigned a chapter number; [s. 25(2)(g)]
- removing a reference to a contingency in a provision that is stated to come into effect when or if that contingency occurs, if that contingency has occurred, or is required as a result of removing such a reference; [s. 25(2)(h)]
- updating a reference to a person, office, organization, place or thing if an Act provides that references to it are deemed or considered to be references to another person, office, organization, place or thing; [s. 25(2)(i)]
- updating a reference to reflect a change in the name, title, location or address of a person, office, organization, place or thing, other than
- a change in the name or title of a document adopted or incorporated by reference unless it was adopted or incorporated as amended from time to time, and
- a change in the title of a minister or the name of a department; [s. 25(2)(j)]
- updating a reference to a minister or department when, under subsection 5(3) of The Executive Government Organization Act, the Act is to be read as if it were amended as necessary to give effect to an order in council made under that Act; [s. 25(2)(k)]
- correcting an error in the numbering of a provision or other portion of an Act, or making a change to a cross-reference required as a result of such a correction; [s. 25(2)(l)]
- correcting an obvious error in a cross-reference, if it is obvious what the correction should be; [s. 25(2)(m)]
- if a provision of a transitional nature is contained in an amending Act, incorporating it as a provision of the consolidated Act and make any other changes that are required as a result; [s. 25(2)(n)]
- removing a provision that is deemed by The Interpretation Act to have been repealed because it has expired, lapsed or otherwise ceased to have effect. [s. 25(2)(o)]

Definitions
1(1) In this regulation,
"general regulation" means the Apprenticeship and Certification — General Regulation, Manitoba Regulation 154/2001; (« règlement général »)
"prevailing journeyperson wage" means the wage rate that, under The Construction Industry Wages Act, applies to a person who practises in the trade; (« salaire en vigueur pour un compagnon »)
"routine maintenance tasks" include
(a) the lubricating of control valve stems,
(b) the adjusting of packing glands on valves and pumps,
(c) the bleeding of moisture and condensation from air compressors, air lines and dry-pipe system auxiliary drains,
(d) the replacing of
(i) worn or missing fire hoses, and
(ii) worn or missing nozzles; (« tâches liées à l'entretien préventif »)
"sprinkler fitter" means a person who performs the following tasks of the trade to the standard indicated in the occupational analysis for the trade:
(a) installs piping for sprinkler and fixed fire protection systems,
(b) installs detection, protection and control systems for sprinkler and fixed fire protection systems,
(c) inspects, tests, maintains and repairs existing sprinkler and fixed fire protection systems and auxiliary equipment,
(d) plans work activities, uses and maintains equipment, including hand and portable power tools, and uses hoisting, lifting and access equipment in the installation, inspection, testing, maintenance and repair of sprinkler and fixed fire protection systems, and
(e) installs water supplies for sprinkler and fixed fire protection systems; (« mécanicien en protection-incendie »)
"trade" means the trade of sprinkler fitter. (« métier »)

1(1) Les définitions qui suivent s'appliquent au présent règlement.
« mécanicien en protection-incendie » Personne qui accomplit les tâches qui suivent en conformité avec les normes de l'analyse professionnelle applicable au métier :

d) planifier le travail, utiliser et entretenir de l'équipement, y compris des outils automatiques à main et des outils électriques portables, et utiliser du matériel de levage et d'accès au cours de l'installation, de l'inspection, de la mise à l'essai, de l'entretien et de la réparation des systèmes de gicleurs et des dispositifs fixes d'extinction d'incendies;

1(2) The provisions, including the definitions, of the general regulation apply to the trade unless inconsistent with a provision of this regulation.

Trade is a compulsory certification trade
2 The trade of sprinkler fitter is designated a compulsory certification trade in Manitoba.

Practising in the trade
3(1) A person practises in the trade when he or she performs a task set out in the definition of the trade.

Limitation re scope of trade
3(2) Despite subsection (1), a person is not practising in the trade when he or she performs
(a) routine maintenance tasks on sprinkler and fixed fire protection systems; or
(b) a task of the trade that he or she is authorized by another enactment to perform.

Apprenticeship levels
4(1) Apprenticeship in the trade is four levels, with each level consisting of a period of at least 12 months during which the apprentice must complete
(a) 1,800 hours of technical training and practical experience, in each of the first three levels; and
(b) 1,800 hours of practical experience in the fourth level.

4(2) Despite subsection (1), the term of apprenticeship for a person who, on or before September 1, 2019, has completed the first level of apprenticeship in the trade — in accordance with the requirements of this regulation, as it read before the coming into force of this section — is four levels, with each level consisting of a period of at least 12 months during which the apprentice must complete 1,700 hours of technical training and practical experience.

Minimum wage rates
6 Unless otherwise prescribed by a payment agreement or enactment that is more favourable to the apprentice, the wage rate for an apprentice shall not be less than
(a) 50% of the prevailing journeyperson wage during the first level;
(b) 60% of the prevailing journeyperson wage during the second level;
(c) 70% of the prevailing journeyperson wage during the third level; and
(d) 80% of the prevailing journeyperson wage during the fourth level.

7 The certification examination for the trade consists of a written interprovincial examination.

8 The Trade of Sprinkler and Fire Protection Installer Regulation, Manitoba Regulation 89/87 R, is repealed.
