Manitoba Regulation 61/2014 amended

1   The Liquor Licensing Regulation, Manitoba Regulation 61/2014, is amended by this regulation.

2   Section 1 is amended

(a) by repealing the definitions "entertainment venue operator" and "veterans organization";

(b) by replacing the definition "adult entertainment" with the following:

"adult entertainment" means any form of dancing or any exhibition, display or event involving a person who is nude or partially nude for any period of time.

(c) by adding the following definitions:

"age-restricted licensed premises" means

(a) premises that are the subject of an age-restricted liquor service licence; or

(b) premises or portions of premises in which minors are prohibited from entering as the result of a term or condition imposed on the applicable general liquor service licence.

"licensee" means the holder of a liquor service licence.

3(1)   Subsection 2(1) is amended by adding "and may establish the maximum capacity of specified areas of the licensed premises" at the end.

3(2)   Subsection 2(2) is amended

(a) by striking out "a sign" and substituting "a notice"; and

(b) by striking out "keep the sign posted" and substituting "post the notice".

3(3)   Subsection 2(3) is amended

(a) by adding "or a specified area of the licensed premises" after "licensed premises"; and

(b) by striking out "for the premises".

4   Subsection 3(2) is repealed.

5   Subsection 5(1) is amended

(a) in clause (a), by striking out "85.2 ml" and substituting "86 ml"; and

(b) in clause (c), by striking out "750 ml" and substituting "1,000 ml".

6   Clause 6(1)(a) is amended by striking out "28.4 ml" and substituting "43 ml".

7   Subsection 8(2) is repealed.

8   Section 8.1 is repealed.

9   Subsection 9(1) is replaced with the following:

Patrons may bring wine to licensed premises

9(1)   A licensee may allow a patron to bring their own commercially-made wine in an unopened bottle to the licensed premises for consumption in the premises.

10(1)   Subsection 9.1(1) is replaced with the following:

Sale of liquor with delivery and takeout food orders

9.1(1)   Every licensee is authorized to sell beer, wine, cider or coolers for consumption outside the licensed premises with food purchased for delivery or takeout from the licensed premises under section 24.1 of the Act.

11   Section 11 is replaced with the following:

Authorized removal of wine

11   A licensee may allow a patron to remove an unfinished bottle of wine from the licensed premises if the licensee recorks the bottle using a new cork that is fully inserted into the bottle so that the top of the cork is flush with the opening of the bottle.

12   Section 14 is repealed.

13   Section 16 is replaced with the following:

Minors may provide entertainment in age-restricted premises

16(1)   A minor may provide entertainment in age-restricted licensed premises if they are accompanied by their parent or guardian.

16(2)   A minor must not provide entertainment in age-restricted licensed premises at any time when adult entertainment is offered in the premises.

14   Section 18 is replaced with the following:

Adult entertainment

18   Adult entertainment may take place only in age-restricted licensed premises or in other licensed premises that have been authorized by the executive director.

15   Subsection 20(2) is repealed.

16   Section 21 is repealed.

17   The following is added after section 22:

Availability of food and non-alcoholic beverages

22.1(1)   Unless authorized by the authority, a licensee must ensure that there is a variety of food and non-alcoholic beverages available to patrons in the licensed premises at all times that the premises are open.

22.1(2)   A licensee may offer food that is prepared outside the licensed premises or prepackaged food that is acceptable to the authority.

Vacating licensed premises

22.2   The licensee of age-restricted licensed premises other than a casino or gaming centre must ensure that all patrons leave the premises within 60 minutes after the time when liquor sales must end in the licensed premises.

18   The centred heading before section 23 and sections 23 to 37 are repealed.

19   Subsection 47(1) is amended

(a) in the section heading, by striking out "in retail liquor premises" and substituting "by retail licensees"; and

(b) by striking out everything after "complimentary sample of liquor" and substituting "to adult patrons.".

20   Section 50 is amended by striking out "licensee" and substituting "manufacturer".

Coming into force

21   This regulation comes into force on the same day that The Liquor, Gaming and Cannabis Control Act, S.M. 2023, c. 6, comes into force.
