THE PERSONAL PROTECTIVE EQUIPMENT REPORTING ACT

WHEREAS having stockpiles of personal protective equipment prevents shortages of that equipment when it is needed;

AND WHEREAS the pandemic caused by the communicable disease known as COVID-19 has demonstrated the need for personal protective equipment to prevent and control infection;

AND WHEREAS it is in the public interest that Manitobans are aware of the inventory of personal protective equipment held by health authorities;

THEREFORE HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Definitions

The following definitions apply in this Act.

"health authority" means a regional health authority as defined in The Regional Health Authorities Act. (« office de la santé »)

"minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act. (« ministre »)

Annual report on supplies of personal protective equipment

2(1)

For each fiscal year of the government, the minister must prepare a report that sets out, with respect to each health authority,

(a) the number of items of personal protective equipment that are purchased during the year; and

(b) the number of items that are held in inventory at the end of the year.

Contents of report

2(2)

The report must include the number of items of the following types of personal protective equipment:

(a) surgical masks;

(b) filtration masks (N95 and higher filtration rate masks);

(c) protective gowns;

(d) face shields;

(e) eye protection;

(f) examination and sterile gloves;

(g) any other type of personal protective equipment, as prescribed by regulation under this Act.

Tabling report in Assembly and publication

Within four months after the end of the fiscal year, the minister must table a copy of the report in the Assembly and make it available to the public.

Regulations

The Lieutenant Governor in Council may make regulations prescribing an item as a type of personal protective equipment for the purpose of clause 2(2)(g).

Conditional amendment

If clause 3(1)(g) of Bill 10, introduced in the Second Session of the 42nd Legislature and titled The Regional Health Authorities Amendment Act (Health System Governance and Accountability), comes into force, the definition "health authority" in section 1 is replaced with the following:

"health authority" means a health authority as defined in The Health System Governance and Accountability Act. (« office de la santé »)

This Act may be referred to as chapter P37 of the Continuing Consolidation of the Statutes of Manitoba.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill establishes The Personal Protective Equipment Reporting Act. A report must be tabled each year in the Legislative Assembly setting out the quantity of personal protective equipment purchased and held by health authorities.
