THE ELECTION FINANCING AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Election Financing Act is amended by this Act.

Column 2 of the table in subsection 61(1) is amended by replacing

(a) the entry opposite "A registered party" with "The leader of the registered party";

(b) the entry opposite "A candidate" with "The candidate"; and

(c) the entry opposite "A leadership contestant" with "The leadership contestant".

Subsection 61(2) is replaced with the following:

(2) — Authorization must be displayed or announced

If the advertisement is printed material, the person listed in Column 2 of the table must ensure that the statement "Authorized by (insert name of person listed in Column 2)" is printed on the advertisement.

If the advertisement is distributed on radio, television or the Internet, the person listed in Column 2 of the table must announce "my name is (insert name of person listed in Column 2) and I authorized this message" during the advertisement.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill amends The Election Financing Act.

It requires every advertisement for a registered party, a candidate or a leadership contestant to be authorized by the leader of the registered party, the candidate or the leadership contestant, respectively.

A printed advertisement must contain a statement that it is authorized by the leader of the party, the candidate or the leadership contestant. For advertisements appearing on radio, television or the Internet, the leader of the party, the candidate or the leadership contestant must personally announce that they authorized the message during the advertisement.
