THE REGULATED HEALTH PROFESSIONS AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Regulated Health Professions Act is amended by this Act.

The following is added after subsection 28(4):

Minister may exempt colleges

28(5)

The minister may, by regulation, exempt a college from the application of subsection (4) if the minister is satisfied that

(a) the college has members who are eligible to submit claims under the Manitoba Health Services Insurance Plan; or

(b) at least 25% of the members of the college provide health care to Manitoba residents for which professional fees are charged to the Manitoba resident or a third party on the resident's behalf.

Subsection 82(3) is repealed.

Clause 104(3)(a) is replaced with the following:

(a) must not include information that the investigated member suffers from an ailment, emotional disturbance or addiction when making the circumstances that led to the censure available under subsection (2); and

Clause 105(4)(a) is replaced with the following:

(a) must not include information that the investigated member suffers from an ailment, emotional disturbance or addiction when making the circumstances that led to the voluntary surrender available under subsection (3); and

Amendments to unproclaimed provisions

This section amends provisions of The Regulated Health Professions Act, as enacted by S.M. 2009, c. 15, that are not yet in force.

The following is added after subsection 190(3):

Minister may exempt college

190(4)

The minister may, by regulation, exempt the college from the application of subsection (3) if the minister is satisfied that at least 25% of the members of the college provide health care to Manitoba residents for which professional fees are charged to the Manitoba resident or a third party on the resident's behalf.

In subsection 208(16), clause 105(4)(a) is replaced with the following:

(a) must not include information that the investigated member suffers from an ailment, emotional disturbance or addiction when making the circumstances that led to the voluntary surrender available under subsection (3); and

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill amends The Regulated Health Professions Act. The minister may exempt a health profession from the statutory prohibition on the online publication of certain health information about disciplined members.

A college of a regulated health profession is not allowed to publish certain health information on the Internet about members who have voluntarily accepted disciplinary measures, but information about the measures may now be made available online.

A college may incorporate its own standards of practice document into the college's regulations.
