HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. L110 amended

1           The Legislative Assembly Act is amended by this Act.

2           Subsection 52.7(3) is replaced with the following:


52.7(3)     The commissioner's term of office ends on the dissolution of the assembly following the commissioner's appointment.

3           Subsection 52.8(1) is amended by adding the following after item 6:

6.1 Any additional allowance for members who have a disability, and the circumstances in which it is to be paid.

4(1)        The following is added after subsection 52.13(1):

Amendment by commissioner

52.13(1.1)  The commissioner may amend a regulation made under section 52.12 if the management commission asks the commissioner to consider whether an amendment should be made to deal with a circumstance not addressed in the commissioner's report submitted to the Speaker under section 52.10.

4(2)        Subsection 52.13(3) is amended by striking out "by the management commission" and substituting "under this section".

Coming into force

5           This Act comes into force one day following the election day of the next general election held after this Act receives royal assent.

Explanatory Note

After each general election, a commissioner appointed under The Legislative Assembly Act decides on the pay and benefits for Members of the Assembly and then makes regulations to implement those decisions.

This Bill gives the commissioner the power to decide on an additional allowance for Members who have a disability, and to determine the circumstances in which it will be paid.

The commissioner's term of office is extended until dissolution of the Assembly. The commissioner will be allowed to amend the regulations that set MLA pay and benefits if the Assembly's management commission asks the commissioner to consider a circumstance that was not previously addressed.
