HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

PART 1

THE WASTE REDUCTION

AND PREVENTION ACT

C.C.S.M. c. W40 amended

The Waste Reduction and Prevention Act is amended by this Part.

Section 6 is repealed.

The following is added after clause 14.2(1)(b):

(c) supporting organic waste management programs and initiatives.

Subsection 20(1) is amended by

(a) by striking out "$25,000." and substituting "$50,000"; and

(b) by striking out "$250,000" and substituting "$500,000".

PART 2

THE ENVIRONMENT ACT

The Environment Act is amended by this Part.

The definition "waste" in subsection 1(2) is amended

(a) by adding "debris from construction, renovation and demolition projects;" after "machinery;"; and

(b) by adding "organic waste;" after "animal wastes;".

The following is added after clause 41(1)(m):

(m.1) prohibiting or restricting the depositing of prescribed types of materials in waste disposal grounds and landfills or in prescribed classes of waste disposal grounds and landfills;

COMING INTO FORCE

This Act comes into force on the day it receives royal assent.

Explanatory Note

Part 1 of this Bill amends The Waste Reduction and Prevention Act. It explicitly allows money from the Waste Reduction and Recycling Support Fund to be used to support organic waste management programs and initiatives. It also increases fines and removes the requirement to have an advisory committee.

Part 2 of the Bill amends The Environment Act. It enables the dumping of designated materials in landfills and waste disposal grounds to be prohibited or restricted by regulation. It also clarifies the definition "waste".
