HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

THE ADDICTIONS FOUNDATION ACT

C.C.S.M. c. A60 amended

1(1)         The Addictions Foundation Act is amended by this section.

1(2)        Subsection 4(2) is amended by striking out "15 persons" and substituting "not less than 9 or more than 15 persons".

1(3)        Subsection 4(4) is replaced with the following:

Chair

4(4)        The Lieutenant Governor in Council must designate one member as chair of the board.

THE ADULT LITERACY ACT

C.C.S.M. c. A6 amended

2            Subsection 10(2) of the French version of The Adult Literacy Act is amended by striking out "dans les 15 premiers jours de séance de celle-ci suivant son établissement" and substituting "dans les 15 jours suivant son achèvement ou, si elle ne siège pas, au plus tard 15 jours après la reprise de ses travaux".

THE MANITOBA AGRICULTURAL SERVICES CORPORATION ACT

C.C.S.M. c. A25 amended

3(1)         The Manitoba Agricultural Services Corporation Act is amended by this section.

3(2)        Section 15 is replaced with the following:

Chair and vice-chair

15(1)       The Lieutenant Governor in Council must designate one director as chair and one director as vice-chair.

Duties of vice-chair

15(2)       The vice-chair has the authority of the chair if the chair is absent or unable to act, or when authorized by the chair.

3(3)         Section 16 is amended by striking out "or a vice-chair" and substituting "or vice-chair".

THE APPRENTICESHIP AND CERTIFICATION ACT

C.C.S.M. c. A110 amended

4            Subsection 5(2) of the French version of The Apprenticeship and Certification Act is amended by striking out "dans les 15 premiers jours de séance de celle-ci suivant sa réception" and substituting "dans les 15 jours suivant sa réception ou, si elle ne siège pas, au plus tard 15 jours après la reprise de ses travaux".

THE ARBITRATION ACT

C.C.S.M. c. A120 amended

5            Subsection 10(4) of the English version of The Arbitration Act is amended by striking out "arbitrations" and substituting "arbitrators".

THE ARCHITECTS ACT

C.C.S.M. c. A130 amended

6            Clause 33(2)(a) of The Architects Act is amended by striking out "the Minister of Family Services and Labour" and substituting "the minister responsible for the administration of The Labour Relations Act".

THE AUDITOR GENERAL ACT

C.C.S.M. c. A180 amended

7            Subsection 28(1) of the French version of The Auditor General Act is amended by striking out "au président; celui-ci le dépose devant l'Assemblée dans les 15 jours suivant sa réception ou, si elle ne siège pas, dans les 15 premiers jours de séance ultérieurs" and substituting "au président. THE BILINGUAL SERVICE CENTRES ACT

C.C.S.M. c. B37 amended

8            The Bilingual Service Centres Act is amended in clause 6(1)(a) of the French version by striking out "Secrétariat des affaires francophones" and substituting "Secrétariat aux affaires francophones".

THE CAREGIVER RECOGNITION ACT

C.C.S.M. c. C24 amended

9            Subsection 9(1) of the French version of The Caregiver Recognition Act is amended

(a) by striking out "une copie" and substituting "un exemplaire"; and

(b) by striking out "sa réception; si l'Assemblée législative ne siège pas, il le rend public et le dépose par la suite dans les 15 premiers jours de séance qui suivent" and substituting "sa réception. Si l'Assemblée ne siège pas, il le rend public sans délai et en dépose un exemplaire devant elle au plus tard 15 jours après la reprise de ses travaux".

THE CEMETERIES ACT

C.C.S.M. c. C30 amended

10(1)       The Cemeteries Act is amended by this section.

10(2)       Section 1 is amended

(a) in the English version, by replacing the definition "board" with the following:

"board" means the Funeral Board of Manitoba established under The Funeral Directors and Embalmers Act; (« conseil »)

(b) in the French version

(i) by striking out the definition "Régie", and

(ii) by adding the following definition:

« conseil » Le Conseil des services funéraires du Manitoba créé sous le régime de la Loi sur les entrepreneurs de pompes funèbres et les embaumeurs. ("board")

10(3)       Section 2.1 is amended

(a) by striking out "under Part 1 of The Public Utilities Board Act" and substituting "under The Funeral Directors and Embalmers Act"; and

(b) in the French version

(i) by striking out "de la Régie" in the section heading and substituting "du conseil",

(ii) by striking out "La Régie" and substituting "Le conseil", and

(iii) by striking out "elle est saisie" wherever it occurs and substituting "il est saisi".

10(4)        Clause 19(1)(a) of the French version is amended by striking out "à la Régie" and substituting "au conseil".

10(5)       Subsection 19(4) is amended by striking out "by the board" and substituting "under this Part".

10(6)       The French version of the following provisions are amended by striking out "la Régie" wherever it occurs and substituting "le conseil", with necessary grammatical changes:

10(7)       The French version of the following provisions are amended by striking out "La Régie" wherever it occurs and substituting "Le conseil", with necessary grammatical changes:

(d) subsections 31(6), (7) and (8).

10(8)       Subsections 25(1), (2) and (3) are amended by striking out "by the board".

10(10)      Subsection 31(2) of the French version is amended

THE CHANGE OF NAME ACT

C.C.S.M. c. C50

11(1)       The Change of Name Act is amended by this section.

11(2)       Clause 10(5)(f) is amended by striking out "Minister of Consumer and Corporate Affairs" and substituting "the minister appointed by the Lieutenant Governor in Council to administer this Act".

11(3)       Clause 11(b) is amended by adding "and providing for the waiver of the payment of those fees by any person or class of persons" after "under this Act".

THE CHANGE OF NAME AMENDMENT ACT

S.M. 2011, c. 20 (unproclaimed provisions amended)

12(1)       The Change of Name Amendment Act, as enacted by S.M. 2011, c. 20, is amended by this section.

12(2)       Clause 3(1)(d) is repealed.

12(3)       Subsection 3(2) is amended by replacing subsection 2(2.2) with the following:

Duties of agency taking fingerprints

2(2.2)      When an authorized agency has fingerprinted an applicant, the agency must provide the applicant's present and proposed name, date of birth and fingerprints to the Royal Canadian Mounted Police for the purpose of linking the applicant's present and proposed name if the applicant has a criminal history.

12(4)       Subsection 3(2) is further amended in subsection 2(2.3) by striking out "has received notice from an authorized agency" and substituting "is satisfied".

12(5)       Section 10.2 is amended by striking out "clause 2(2.2)(a)" and substituting "subsection 2(2.2)".

THE CHARITIES ENDORSEMENT ACT

C.C.S.M. c. C60 repealed

13           The Charities Endorsement Act, R.S.M. 1987, c. C60, is repealed.

THE CLIMATE CHANGE AND EMISSIONS REDUCTIONS ACT

C.C.S.M. c. C135 amended

14           Subsection 17(3) of the French version of The Climate Change and Emissions Reductions Act is amended by striking out "dans les 15 premiers jours de séance de celle-ci suivant sa réception" and substituting "dans les 15 jours suivant sa réception ou, si elle ne siège pas, au plus tard 15 jours après la reprise de ses travaux".

THE COARSE GRAIN MARKETING CONTROL ACT

C.C.S.M. c. C140 repealed

15           The Coarse Grain Marketing Control Act, R.S.M. 1987, c. C140, is repealed.

THE COMMUNITIES ECONOMIC DEVELOPMENT FUND ACT

C.C.S.M. c. C155 amended

16           Subsection 22(3.1) of the French version of The Communities Economic Development Fund Act is amended

(a) in the section heading, by striking out "à l'Assemblée législative" and substituting "devant l'Assemblée"; and

S.M. 2011, c. 30, Schedule A (unproclaimed provisions amended)

17(1)       The Condominium Act, as enacted by S.M. 2011, c. 30, Schedule A, is amended by this section.

17(2)       Subsection 54(5) is amended

(a) in clause (a), by striking out "the seller" and substituting "in person to the seller or the seller's authorized representative"; and

(b) in clause (b), by striking out "agent" and substituting "authorized representative".

17(3)       Subsection 56(1) is amended by striking out "agent" and substituting "authorized representative".

17(4)        Subsection 61(1) is amended by adding the following after clause (b):

(c) any other prescribed information.

17(5)        Clause 239(a) is amended in the English version by striking out "phased-development property" and substituting "phased development".

17(6)       Subsection 255(1) of the English version is amended by adding "and" at the end of clause (p).

17(7)       Clause 293(1)(l) is amended by striking out "the manner" and substituting "the form and manner".

THE CONSTITUTIONAL QUESTIONS ACT

C.C.S.M. c. C180 amended

18           Subsection 7(5) of The Constitutional Questions Act is amended

(a) in the section heading, by striking out "Fourteen" and substituting "Thirty"; and

(b) by striking out "14 days" and substituting "30 days".

THE CONSUMER PROTECTION ACT

C.C.S.M. c. C200 amended

19(1)        The Consumer Protection Act is amended by this section.

19(2)       Subsection 59(1) of the English version is amended in the part before clause (a) by striking out "vendors" and substituting "vendor's".

19(3)        Subsection 136(11) of the French version is amended by adding "ou (8)" after "paragraphe (5)".

19(4)        Subsection 148(3) of the English version is amended by adding "be" after "it must".

THE CORPORATIONS ACT

C.C.S.M. c. C225 amended

20(1)        The Corporations Act is amended by this section.

20(2)       Section 241 is amended by striking out "petition, originating notice of motion," and substituting "notice of application".

20(3)       Subsection 267(2) is amended in the part after clause (d) by striking out "Minister of Local Government" and substituting "Minister of Agriculture, Food and Rural Initiatives".

THE COUNCIL ON POST-SECONDARY EDUCATION ACT

C.C.S.M. c. C235 amended

21           Subsections 16(2) and 24(3) of the French version of The Council on Post-Secondary Education Act are amended by striking out "devant l'Assemblée législative immédiatement ou, si elle ne siège pas, le rend public sans délai et en dépose un exemplaire dans les 15 premiers jours de séance ultérieurs" and substituting "devant l'Assemblée. 22           Subsection 19.1(1) of the English version of The Criminal Property Forfeiture Act is amended by adding "and" at the end of clause (a).

THE CROWN CORPORATIONS PUBLIC REVIEW AND ACCOUNTABILITY ACT

C.C.S.M. c. C336 amended

23           Subsections 7(2), 19(2) and 20(3) of the French version of The Crown Corporations Public Review and Accountability Act are amended by striking out "immédiatement ou, si elle ne siège pas, dans les 15 premiers jours de séance ultérieurs" and substituting "sans délai ou, si elle ne siège pas, au plus tard 15 jours après la reprise de ses travaux".

24(1)        The Discriminatory Business Practices Act is amended by this section.

24(2)        Subsection 8(10) is amended by striking out "Subsection 21(3), section 22" and substituting "Section 22".

THE DRIVERS AND VEHICLES ACT

C.C.S.M. c. D104 amended

25(1)        The Drivers and Vehicles Act is amended by this section.

25(2)        Subsection 29(3) is amended by striking out "24 hours" and substituting "45 days".

25(3)       Clause 77(2)(a) and the part of subsection 77(3) before clause (a) are amended by striking out "mentioned in section 249 of that Act" and substituting "required of an off-road vehicle owner by subsection (1)".

25(4)       Subsection 150.6(2) is amended in the English version by striking out "licence" and substituting "card".

THE ECONOMIC INNOVATION AND TECHNOLOGY COUNCIL ACT

C.C.S.M. c. E7 amended

26           Section 26 of the French version of The Economic Innovation and Technology Council Act is replaced with the following:

27(2)       Subsection 74(3) is amended by adding the following at the end of Rule 1:

The candidate and his or her official agent must ensure that the reimbursement amount is used first to pay the candidate's outstanding liabilities, if any.

27(3)        Clause 81(2)(a) is amended in the French version by striking out "au scrutin" and substituting "aux sondages".

27(4)        Subsection 86(2) is amended in the English version by striking out "officer" and substituting "agent".

THE ELECTIONS ACT

C.C.S.M. c. E30 amended

28           Subsection 32(3) of the French version of The Elections Act is amended by striking out "dans les 15 premiers jours de séance ultérieurs" and substituting "au plus tard 15 jours après la reprise de ses travaux".

34           Section 17 of the French version of The Manitoba Film and Sound Recording Development Corporation Act is amended

THE FREEDOM OF INFORMATION AND PROTECTION OF PRIVACY ACT

37(1)        The Freedom of Information and Protection of Privacy Act is amended by this section.

37(3)       Subsection 67(3) is replaced with the following:

67(3)       An appeal is to be made by filing an application with the court

(a) within 30 days after the deadline set out in subsection 66.1(4) expires, if the Ombudsman's report under section 66 contains recommendations respecting the complaint; or

(b) within 30 days after receiving the Ombudsman's report, if the report does not contain recommendations.

THE FUNERAL DIRECTORS AND EMBALMERS ACT

38          Section 22 of The Funeral Directors and Embalmers Act is amended by striking out "or the regulations" and substituting ", The Cemeteries Act or the regulations under those Acts".

THE MANITOBA HABITAT HERITAGE ACT

39           Subsection 24(2) of the French version of The Manitoba Habitat Heritage Act is replaced with the following:

Temporary licence

31(7)       Despite subsection (6), the registrar may issue a temporary driver's licence for a period of not more than 45 days, subject to any conditions or restrictions that the registrar considers appropriate.

42(3)       Subsection 61(2) of the French version is amended by striking out "toutre" and substituting "toute".

42(4)        Subsection 137(2) is amended by striking out "AUTOBUS SCOLAIRE" and substituting "ÉCOLIERS".

42(5)       Subsection 213(1) of the French version is amended

(a) in the section heading, by striking out "alcooliques" and substituting "alcoolisées"; and

(b) by striking out "alcoolique" and substituting "alcoolisée".

42(6)        The following is added after subsection 226(1):

Non-application of subsection (1) to certain vehicles

226(1.1)    Subsection (1) does not apply to a vehicle that is registered and insured as required by Part 5 of The Drivers and Vehicles Act Registration of Off-Road Vehicles).

42(7) Subsection 242.1(16) of the French version is amended by striking out everything after "ministre" and substituting "de la Justice. Il dépose un exemplaire du rapport devant l'Assemblée sans délai ou, si elle ne siège pas, au plus tard 15 jours après la reprise de ses travaux.".

42(9) The following is added after subsection 279(23):

Extension of temporary licence issued by registrar

279(23.1)   If a person has filed an appeal from the suspension of his or her driver's licence and has been issued a temporary driver's licence by the registrar under subsection 31(7) of this Act or subsection 29(3) of The Drivers and Vehicles Act, the chair of the appeal board or a person designated by the chair may extend the temporary driver's licence for a period of not more than 45 days beyond the expiration date specified by the registrar. The chair must provide the registrar with a copy of any order made under this subsection.

42(10)      Clause 279.1(7)(b.1) of the French version is amended in the part before subclause (i) by striking out "registaire" and substituting "registraire".

42(11)      Clause 319(1)(ttt) is amended by striking out "and" at the end of subclause (vi) and adding the following after subclause (vii):

(viii) authorizing an employee of the department — described in the regulation — to issue, with or without conditions, a permit exempting the operator of a motor vehicle, or a class of such operators, from the application of a regulation made for the purpose of subclause (v) and (vi), and

(ix) respecting permits under subclause (viii), including prescribing the maximum period for which a permit may be issued, prescribing eligibility criteria, governing the process for obtaining a permit and governing the suspension or cancellation of a permit;

THE HUMAN RIGHTS CODE

43(1)       The Human Rights Code is amended by this section.

43(2)       Section 37.1 is replaced with the following:

Adjudicator to determine reasonableness of offer

37.1(1)     When a settlement offer is made after an adjudicator is appointed to hear the complaint, the chief adjudicator must designate a different member of the adjudication panel to determine if the settlement offer is reasonable.

Failure to accept reasonable settlement offer

37.1(2)     If a complainant rejects a settlement offer that the adjudicator designated under subsection (1) considers to be reasonable, that adjudicator must terminate the adjudication to the extent that it relates to the parties to the settlement offer.

43(3)       Subsection 59(1) is amended in the part after clause (b) by striking out "subsections 21(7) and" and substituting "subsection".

THE MANITOBA HYDRO ACT

(b) payment of the amount is proven by filing with the treasurer a receipt containing prescribed information and signed by the financial officer of the registered party or the official agent of the registered candidate, as the case may be.

Interpretation

4.11(3)     For the purposes of this section, "contribution", "financial officer", "non-monetary contribution", "official agent", "registered candidate" and "registered party" have the same meanings as in The Election Financing Act.

COMING INTO FORCE

Coming into force

79(1)       This Act, except sections 13, 18, 49 and 75, comes into force on the day it receives royal assent.

79(2)       Section 13 comes into force on December 31, 2013.

79(3)       Section 18 comes into force on October 1, 2013.

79(4)       Section 49 comes into force on the same day that section 39 of The Food Safety and Related Amendments Act, S.M. 2009, c. 8, comes into force.

79(5)       Section 75 is deemed to have come into force on April 1, 2013.

This Bill corrects typographical, numbering and drafting errors. It also makes minor amendments to several Acts. The Bill repeals a private Act and three outdated or obsolete Acts.
