THE HIGHWAY TRAFFIC AMENDMENT ACT (DENIAL OF LICENCES — OUTSTANDING WARRANTS)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Highway Traffic Act is amended by this Act.

The following is added after section 273.5:

Service to be refused if warrant for serious offence

273.6

If the registrar is satisfied that a warrant for arrest has been issued for a person in respect of a prescribed indictable offence, the registrar shall, until satisfied the warrant has been executed or cancelled,

(a) refuse to issue or renew a driver's licence or permit in the name of the person; and

(b) refuse to accept payment from the person of any charge payable in relation to the driver's licence or permit, even though the refusal may lead to its suspension.

The following is added after clause 319(1)(eeee):

(eeee.1) prescribing indictable offences for the purpose of section 273.6;

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill amends The Highway Traffic Act to prohibit a person from being issued or renewing a driver's licence if a warrant for a serious indictable offence is outstanding for the person's arrest.
