THE HIGHWAY TRAFFIC AMENDMENT ACT (DENIAL OF LICENCES — OUTSTANDING WARRANTS)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. H60 amended

1           The Highway Traffic Act is amended by this Act.

2           The following is added after section 273.5:

Service to be refused if warrant for serious offence

273.6       If the registrar is satisfied that a warrant for arrest has been issued for a person in respect of a prescribed indictable offence, the registrar shall, until satisfied the warrant has been executed or cancelled,

(a) refuse to issue or renew a driver's licence or permit in the name of the person; and

(b) refuse to accept payment from the person of any charge payable in relation to the driver's licence or permit, even though the refusal may lead to its suspension.

3           The following is added after clause 319(1)(eeee):

(eeee.1) prescribing indictable offences for the purpose of section 273.6;

Coming into force

4           This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill amends The Highway Traffic Act to prohibit a person from being issued or renewing a driver's licence if a warrant for a serious indictable offence is outstanding for the person's arrest.
