THE HIGHWAY TRAFFIC AMENDMENT ACT (BICYCLE HELMETS)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Highway Traffic Act is amended by this Act.

2(1)

Subsection 145(4) is replaced with the following:

145(4)

Subject to the regulations made under subsection (4.1), no person who is under 16 years of age shall ride on or operate a bicycle or a power-assisted bicycle on a highway or bicycle facility unless he or she is wearing a properly fitted and fastened protective helmet.

The following is added after subsection 145(4):

Regulations re exemption

145(4.1)

The Lieutenant Governor in Council may make regulations exempting a person or class of persons from the requirements of subsection (4) and may prescribe conditions for those exemptions.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill requires a person under 16 years of age riding a bicycle or a power-assisted bicycle on a highway or bicycle path to wear a proper protective helmet. Regulations may be made to exempt persons or classes of persons from the requirement.
