THE PUBLIC SCHOOLS AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Public Schools Act is amended by this Act.

Clause 9(5.1)(b) is replaced with the following:

(b) does not result in rights, property, debts, obligations, liabilities or employees of a school division or school district being transferred to another school division or school district without the consent of the respective school divisions or school districts; and

Subsection 41.1(1) is amended by adding "of the operating fund" after "financial position".

Section 70 is amended

(a) by renumbering it as subsection 70(1); and

(b) in clause (b), by striking out "$20,000." and substituting "the amount prescribed under subsection (2),".

The following is added as subsection 70(2):

Regulations re tender limit

The minister may make regulations prescribing the cost of personal property and contracted services above which a school board must, except in an emergency, solicit competitive offers by public tender.

Subsection 244(2) of the English version is amended by striking out "refuses of fails" and substituting "refuses or fails".

Clause 259(1)(b) is amended by adding "or certificate of completion," after "graduation diploma".

Subsection 259(2) is amended by adding "and "certificate of completion"" after ""graduation diploma"".

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

The Bill amends The Public Schools Act.

It clarifies the ability of the board of reference to transfer, add or remove minor amounts of land from a school division or school district without the consent of the divisions or districts that may be affected.  However, changes that result in rights, property, debts, obligations, liabilities or employees of a school division or school district being transferred continue to require consent.

In addition, the threshold for requiring school boards to use public tenders when acquiring personal property is to be prescribed by regulation.

Administrative amendments are also made.
