THE CROWN APPOINTMENT REVIEW ACT (VARIOUS ACTS AMENDED)


Explanatory Note

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. H190 amended

1(1)

The Manitoba Hydro Act is amended by this section.

1(2)

The following is added after section 5:

Appointment referred to committee of the Assembly

5.1(1)

Before appointing a person as a member of the board, the President of the Executive Council must refer the proposed appointment to a committee of the Assembly.  The committee must include at least one representative from every political party that is represented in the Assembly.

Person to be publicly interviewed by committee

5.1(2)

The committee must interview the person in public to determine whether he or she is well qualified to serve on the board.

Notice of interview

5.1(3)

Each member of the committee must be given notice, at least seven days in advance, of the date, time and place for holding the interview.

Committee is to provide advice

5.1(4)

After the interview, the committee must advise the President of the Executive Council whether the person is well qualified to serve on the board.

Advice to be considered

5.1(5)

Before making the appointment, the President of the Executive Council must consider the advice of the committee.

C.C.S.M. c. L160 amended

2(1)

The Liquor Control Act is amended by this section.

2(2)

The following is added after section 4:

4.1(1)

Before a person is appointed as a member of the commission, the President of the Executive Council must refer the proposed appointment to a committee of the Assembly.  The committee must include at least one representative from every political party that is represented in the Assembly.

The committee must interview the person in public to determine whether he or she is well qualified to serve on the commission.

Notice of interview

4.1(3)

Each member of the committee must be given notice, at least seven days in advance, of the date, time and place for the interview.

After the interview, the committee must advise the President of the Executive Council whether the person is well qualified to serve on the commission.

Advice to be considered

4.1(5)

In deciding whether the appointment should be made, the President of the Executive Council must consider the advice of the committee.

3(1)

The Manitoba Lotteries Corporation Act is amended by this section.

3(2)

The following is added after section 15:

15.1(1)

4(1)

The Manitoba Public Insurance Corporation Act is amended by this section.

4(2)

The following is added after section 2:

Appointment referred to committee of the Assembly

2.1(1)

Before a person is appointed as a director of the corporation, the President of the Executive Council must refer the proposed appointment to a committee of the Assembly.  The committee must include at least one representative from every political party that is represented in the Assembly.

Person to be publicly interviewed by committee

2.1(2)

The committee must interview the person in public to determine whether he or she is well qualified to serve as a director of the corporation.

Notice of interview

2.1(3)

Each member of the committee must be given notice, at least seven days in advance, of the date, time and place for the interview.

Committee to provide advice

2.1(4)

After the interview, the committee must advise the President of the Executive Council whether the person is well qualified to serve as a director.

Advice to be considered

2.1(5)

In deciding whether the appointment should be made, the President of the Executive Council must consider the advice of the committee.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill requires a person to be publicly interviewed by a committee of the Legislative Assembly before being appointed to the board of Manitoba Hydro, the Liquor Control Commission, Manitoba Lotteries Corporation or Manitoba Public Insurance Corporation.
