THE LEGISLATIVE ASSEMBLY AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Legislative Assembly Act is amended by this Act.

The following is added after section 31:

Speaker continues in office following dissolution

31.1

The person who is the Speaker at the time of a dissolution of the Legislative Assembly continues to hold office as Speaker until a Speaker is elected by the new Assembly.

Subsection 52.13(1) is replaced with the following:

Amendment by management commission

52.13(1)

The management commission may amend a regulation made under section 52.12 if

(a) the amendment is of an administrative or technical nature; or

(b) the management commission considers the amendment necessary to address unforeseen circumstances arising after the last commissioner's report was submitted to the Speaker under section 52.10.

Section 52.15 is amended in item 3 by adding", other than that of Speaker," after "additional position".

Additional payment for incumbent Speaker (2003 to 2005)

For the period from June 3, 2003 to April 1, 2005, the person who was elected Speaker on June 23, 2003 is entitled to be paid the same additional salary that was paid to members of the Executive Council during that period.

Additional payment for incumbent Speaker (2007)

For the period from May 22, 2007 to June 6, 2007, the person who was elected Speaker on June 6, 2007 is entitled to be paid the additional salary that is payable to the Speaker under item 2(a) of subsection 52.8(1).

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill provides that the Speaker of the Legislative Assembly continues to hold office after the Assembly is dissolved until a Speaker is elected by the new Assembly.  It also makes retroactive pay adjustments for the incumbent Speaker.

This Bill also expands the ability of the Legislative Assembly Management Commission to amend regulations made by the commissioner.
