THE PLANNING AMENDMENT ACT (DEEMED SINGLE OPERATIONS)

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Planning Act is amended by this Act.

The following is added after section 1:

Related nearby livestock operations deemed to be one operation

1.1

For the purposes of this Act, if two or more existing or proposed livestock operations involving the same category of livestock are

(a) located within 800 metres of one another; and

(b) owned by

(i) the same individual, corporation, partnership or other entity, or

(ii) individuals, corporations, partnerships or other entities that are interrelated to the degree prescribed by regulation;

they are deemed to be a single livestock operation, and the number of existing or proposed animal units in each operation must be added together.

The following is added after clause 193(1)(b):

(b.1) prescribing the required degree of interrelationship between individuals, corporations, partnerships or other entities for the purpose of section 1.1;

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

Under this Bill, two or more existing or proposed livestock operations will be treated as a single operation if they have the same owner or related owners and are located within 800 metres of each other.
