THE SAFER COMMUNITIES AND NEIGHBOURHOODS AMENDMENT ACT


Explanatory Note

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. S5 amended

1           The Safer Communities and Neighbourhoods Act is amended by this Act.

2           The definition "specified use" in subsection 1(1) is amended

(a) in clause (d), by adding "growth, production," before "possession, use" and by striking out "or" at the end;

(b) in clause (e), by striking out "and" and substituting "or"; and

(c) by adding the following after clause (e):

(f) for the sexual abuse or sexual exploitation of a child or activities related to the sexual abuse or sexual exploitation of a child, or

(g) for the possession or storage of

(i) a prohibited firearm, prohibited weapon, restricted firearm or restricted weapon, as those terms are defined in section 84 of the Criminal Code (Canada), unless the possession or storage is authorized by law,

(ii) a firearm, prohibited weapon or restricted weapon that has been imported into Canada in contravention of the Firearms Act (Canada) or any other federal act or regulation,

(iii) a stolen firearm, or

(iv) an explosive, as defined in the Explosives Act (Canada), in contravention of that Act or any regulation made under that Act;

3           The following is added after subsection 1(1):

Clarifying scope of "specified use"

1(1.1)      For greater certainty, subclause (g)(i) of the definition "specified use" does not apply to a rifle, shotgun or other firearm — whether registered or unregistered under the Firearms Act (Canada) — that does not meet the definition of a prohibited firearm or a restricted firearm in section 84 of the Criminal Code (Canada).

Coming into force

4            This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill allows an order to be made under The Safer Communities and Neighbourhoods Act to vacate and shut down a building in which

  • illegal drugs are grown or produced;
  • children are sexually abused or exploited;
  • prohibited or restricted firearms — such as sawed-off shotguns, machine guns and handguns — are illegally stored;
  • stolen or illegally imported firearms are stored;
  • prohibited or restricted weapons — such as switchblade knives and brass knuckles — are illegally stored; or
  • explosives are illegally stored.
