THE MUNICIPAL ASSESSMENT AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Municipal Assessment Act is amended by this Act.

The definition "council" in subsection 1(1) is amended by replacing everything before clause (a) with the following:

"council" means the council of a municipality and, except in subsection 6(1.1), includes

The following is added after subsection 6(1):

Regulations re varying portions

6(1.1)

The Lieutenant Governor in Council may make regulations authorizing a council, by by-law, to

(a) vary a percentage described under clause (1)(c) by an amount, or within a range, fixed in the regulation; and

(b)  prescribe the class or classes of assessable property that the variation may apply to.

The centred heading before section 331 and section 331 of The City of Winnipeg Charter are repealed.

Coming into force

This Act comes into force on a day to be fixed by proclamation.

Explanatory Note

The City of Winnipeg Charter currently enables regulations to be made authorizing council to vary the percentage of assessed value for prescribed classes of assessable property for the purposes of determining portioned value.

This Bill moves that provision to The Municipal Assessment Act and makes it applicable to all municipalities.
