THE MANITOBA COUNCIL ON AGING ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Definitions

The following definitions apply in this Act.

"council" means the Manitoba Council on Aging continued in section 2. (« Conseil »)

"minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act. (« ministre »)

The "Manitoba Council on Aging" is continued.

Responsibilities of council

The council is responsible for

(a) providing the minister with information and advice about

(i) the aging process and its implications for all age groups in Manitoba, and

(ii) programs, services, policies and legislation that relate to the aging process and the needs and interests of older Manitobans; and

(b) promoting awareness and understanding of the aging process and its implications for all age groups in Manitoba.

Members of council

4(1)

The council is to consist of a maximum of 15 persons who are appointed by the Lieutenant Governor in Council.

Appointing members

4(2)

In appointing or reappointing persons to the council, the Lieutenant Governor in Council must endeavour to select persons who are representative of the geographic regions and the cultural and socio-economic groups in Manitoba.

Term of office

4(3)

A member is appointed for the term fixed in the order appointing him or her, which must not exceed two years.

Successive terms

4(4)

No member may serve more than four years in successive terms.

Appointment continues

4(5)

A member continues to hold office until he or she is reappointed, the appointment is revoked or a successor is appointed.

Vacancy

4(6)

The Lieutenant Governor in Council may fill a vacancy on the council by appointing a person to fill the unexpired term of a former member, and an appointment to the unexpired term is not to be considered a term of office for the purpose of subsection (4).

Chair and vice-chair

4(7)

The Lieutenant Governor in Council must designate one of the members of the council as chair and another member as vice-chair.

Function of vice-chair

4(8)

The vice-chair has the authority of the chair when the chair is absent or unable to act, or when authorized by the chair.

Meetings

The council must hold at least four meetings each year.

Procedure

The council may determine its own practice and procedure.

Minister may refer matter to council

The minister may refer to the council any matter relating to the council's responsibilities.  The council must consider the matter and give the minister a written report of its findings or recommendations.

The council may refer to the minister for consideration any matter relating to its responsibilities.

Council to submit annual report to minister

9(1)

The council must submit to the minister an annual report of its affairs and activities.

Annual report

9(2)

The minister must include the council's annual report in the annual report of his or her department.

Transitional: members of former council

A person

(a) who was appointed to the Manitoba Council on Aging as it was constituted immediately before the coming into force of this Act ("former council"); and

(b) whose term of office has not expired on the coming into force of this Act;

is deemed to be appointed under this Act for a term that is equal to the unexpired portion of his or her term on the former council.  The person may then be reappointed in accordance with subsection 4(3) and despite subsection 4(4), may serve up to four more years.

This Act may be referred to as chapter C233 of the Continuing Consolidation of the Statutes of Manitoba.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill continues the Manitoba Council on Aging.  The council provides advice to government on matters relating to the aging process and the needs of seniors.  It also promotes public understanding about the aging process.
