THE AMUSEMENTS AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

C.C.S.M. c. A70 amended

1           The Amusements Act is amended by this Act.

2(1)        Subsection 42(3) is amended

(a) by replacing the section heading with"Offence re films classified as "Restricted" or "Adult""; and

(b) in the subsection, by striking out "18+" and substituting "Adult".

2(2)        Subsection 42(4) is replaced with the following:

Offence re films classified as "18 Accompaniment"

42(4)       Except where otherwise provided by this Act or the regulations, no person shall distribute, sell, lease, supply, display, advertise, exhibit or present any film that under the regulations is classified as "18 Accompaniment" to another person who has not attained the age of 18 years unless the other person is at least 14 years of age and accompanied by an adult.

42(5)       Except where otherwise provided by this Act or the regulations, no person shall distribute, sell, lease, supply, display, advertise, exhibit or present, any film that under the regulation is classified as "14 Accompaniment" to another person who has not attained the age of 14 years, unless the other person is accompanied by an adult.

3           Section 44 is amended in the part before clause (a) by striking out "wilfully".

4           Clause 53(b.2) is amended by striking out "18+" and substituting "Adult".

Coming into force

5           This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill amends the offence provisions in The Amusements Act to reflect the new film classification categories established under the regulations.
