HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

S.M. 1988-89, c. 41 repealed

1

The Health Sciences Centre Act is repealed.

Consequential amendment, C.C.S.M. c. C20

2

Clause 2(c) of The Cancer Treatment and Research Foundation Act is amended by striking out "Health Sciences Centre" and substituting "Winnipeg Regional Health Authority".

Consequential amendment, C.C.S.M. c. M226

3

The Municipal Assessment Act is amended by striking out clause 22(1)(c) and substituting the following:

(c) is real property that was exempt from taxation under subsection 6(1) of The Health Sciences Centre Act immediately before April 1, 2000 and that continues to be used for a purpose for which an exemption was available on that day;

(c.1) is real property (other than a residence) owned or beneficially owned by the Winnipeg Regional Health Authority — or owned by a corporation of which the Winnipeg Regional Health Authority is a shareholder or member and which has as its shareholders or members only not-for-profit corporations — and located in The City of Winnipeg within the area bounded on the west by Tecumseh Street, on the south by Notre Dame Avenue, on the east by Sherbrook Street, and on the north by the back lane on the north side of William Avenue;

(c.2) is a residence operated by or in connection with the Winnipeg Regional Health Authority for undergraduate students in the health professions who are taking training at the Health Sciences Centre, to a maximum exemption of 0.81 hectare;

Saving provision for Children's Hospital

4

Every reference to The Children's Hospital of Winnipeg in a will or testamentary disposition is conclusively deemed to be a reference to The Children's Hospital Foundation of Manitoba Inc.

Coming into force

5

This Act is retroactive and is deemed to have come into force on April 2, 2000.

Explanatory Note

On April 1, 2000 the corporation known as the Health Sciences Centre was dissolved and its operations were transferred to the Winnipeg Regional Health Authority.

This Bill repeals the Act that incorporated the Health Sciences Centre.  It also preserves the Centre's exemption from property tax by an amendment to The Municipal Assessment Act and carries forward a provision from the repealed Act dealing with bequests to the Children's Hospital.
