THE PUBLIC SCHOOLS AMENDMENT ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

The Public Schools Act is amended by this Act.

Section 196 is amended by striking out "and subject to the approval of the Lieutenant Governor in Council,".

Section 197 is repealed and the following is substituted:

Special grants

The Minister of Finance, on the requisition of the minister, may make special grants to school divisions or school districts from money authorized by an Act of the Legislature to be paid for that purpose.

The following is added after section 260:

Home school to be registered

260.1(1)

The parent or guardian of a child who is a pupil in a home school shall register the school with the minister.

When registration to take place

260.1(2)

The parent or guardian shall register the home school, in a form approved by the minister, when it is first established and on or before September 1 in each year.

Information to be provided to minister

260.1(3)

Within 30 days after a home school is first established and on or before September 1 in each year, the parent or guardian shall provide the minister with the following information:

(a) the name and birth date of each pupil in the school;

(b) the name of the school or school division each pupil would otherwise attend; and

(c) an outline of the education program and grade level for each pupil.

Periodic progress reports

260.1(4)

The parent or guardian shall provide the minister with periodic progress reports on each pupil in the home school. The reports must contain the information and be provided according to a schedule determined by the minister.

Coming into force

This Act comes into force on the day it receives royal assent.

Explanatory Note

This Bill requires parents or guardians who home school their children to register with government.  Parents are required to provide the minister with information about the home school as well as periodic progress reports on each child.

In addition, the Bill eliminates the current requirement in sections 196 and 197 of The Public Schools Act for Cabinet to specifically approve certain grants to organizations and to school divisions and districts.
