Farm Practices Protection Board
PURPOSE OF PROGRAM/SERVICE
The Farm Practices Protection Board is established pursuant to The Farm
Practices Protection Act. The Act establishes a process for reviewing and
mediating nuisance disputes arising from practices of legally established
agricultural operations. The Act is intended to provide protection from nuisance
suits to agricultural operations that conduct their activities in a normal
manner. The Act also provides for changes to practices that are unacceptably
disturbing its neighbours.
The Board will only consider complaints about odour, noise, dust and other
disturbances from farm practices. It will not deal will pollution issues,
erosion problems, humane treatment of animals or other non-nuisance items. The
Board may investigate situations, gather evidence, hold hearings and rule on
acceptability of the farm practices. The Board can dismiss the complaint if it
concerns a normal farm practice. If the practice is not normal, the Board can
order the practice to cease or to be modified.
WHO QUALIFIES
A person aggrieved by any odour, noise, dust or other disturbance from an
agricultural operation may refer a written complaint to the Board. The complaint
must state the name, address and location of the farm operation and the
complainant’s name and address.
